CITY OF RUSSELLVILLE, KENTUCKY
AN ORDINANCE AMENDING ORDINANCE 2007-18 TO LIMIT YARD SALES AND TAG SALES IN RESIDENTIAL ZONES AND TO REQUIRE A BUSINESS LICENSE FOR YARD SALES AND TAG SALES IN COMMERCIAL B-2 ZONES
WHEREAS, City of Russellville, Kentucky, Ordinance 2007-18, establishes requirements pertaining to an occupational license and accompanying taxes; AND
WHEREAS, in order to better serve the economic and aesthetic interests of the City of Russellville and its citizens, the City Council of Russellville, Kentucky, deems it appropriate and necessary to revise said ordinance with regards to yard sales and tag sales.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of Russellville, Kentucky as follows:
SECTION I. SUBSTANTIVE AMENDMENTS.
Ordinance 2007-18, Section 2 - Occupational License Application Required, paragraph
(5), is hereby amended as follows:
(5) Yard Sales & Tag Sales:
(a) No person shall conduct more than two (2 ) yard sales or tas sales, or a combination of the two, within a calendar year at the same physical address within
a Residential Zone.
(b) Persons who conduct yard / sales or tag sales within a Commercial B-2 Zone more than twice per- calendar year are required to register as a business in accordance with this ordinance and are required to remit annual net profit tax to the City of Russellville.
SECTION II. SEVERABILITY.
The provisions of this Ordinance are severable. If any sentence, clause, or part of this Ordinance or the application thereof to any particular state of case is for any reason found to be unconstitutional, illegal or invalid, such un unconstitutionality, illegality or invalidity shall not affect or repeal any of the remaining provisions, sentences, clauses or sections or parts of this Ordinance, it being the legislative intent of this body to ordain and in act each other.
SECTION III. REPEAL OF EXISTING ORDINANCES.
All ordinances or parts of ordinances in conflict herewith now in effect, to the extent of said conflict, are hereby repealed.
SECTION IV. EFFECTIVE PATE.
This ordinance shall become effective upon passage and publication as required by law.
